This Legal Notice regulates the conditions for using and browsing the web platform http://portalentochallege.es (henceforth, "the Platform").

Accessing, browsing and using the Platform implies being a user of it (henceforth, "the user"), and therefore the entails the user’s explicit, unreserved acceptance of all the terms and condition contained in this Legal Notice. Therefore, we recommend that you read it carefully so that if you do not agree with it or with the privacy and cookies policies to which it is objected, you can simply not accept it by the means set up for this purpose, which will make it impossible to use the Platform, the services and the functionalities set up via the Platform.

1. GENERAL INFORMATION.

In compliance with the provisions of Law 34/2002, dated 11 July 2002, on information society services and electronic commerce, the owner of the Platform is FUNDACIÓN ONCE (henceforth, "FUNDACIÓN ONCE" or "we"), approved and qualified by the Ministry of Social Affairs as a private charity organisation that provides assistance, with electronic address http://fundaciononce.es, tax ID (CIF) number G-78661923 and headquartered in Madrid, Calle Sebastián Herrera, no. 15.

2. WEB PLATFORM: USE, PURPOSE AND LEGAL REGIMEN APPLICABLE.

The Platform is an additional support and communication mechanism which the FUNDACIÓN ONCE makes available to users. The main functionalities of the Platform will be to spread the word about the X Talento Challenge programme.

The Platform is subject to Spanish laws; specifically Law 34/2002, dated 11 July 2002, on information society services and electronic commerce, is applicable to the Platform. Likewise, regarding the processing of personal data, it is also subjected to Spanish data protection laws. For more information, please see our private and cookies policies.

3. ACCEPTANCE OF CONDITIONS OF USE.

Access to all the functionalities on this Platform implies acceptance of each of these conditions, as well as any other that may be established, modified and/or expanded by the present or future needs of the Service. The FUNDACIÓN ONCE is authorised to change the content of these conditions at any time, as well as the services and functionalities made available on the Platform; to do so, it is sufficient to publish these changes and modifications via the present means, notwithstanding the possibility for the user to accept these modifications or not. If the user does not accept them, this may mean that their use of the Platform or all or some of the functionalities set up on it may be impeded.

4. CONDITIONS OF ACCESS AND USE.

The user pledges to make appropriate, licit use of the Platform, as well as the contents, products and services made available on it, in accordance with the applicable laws at all times, these conditions, morality and good practices and the public order.

Generally speaking, access to the different functionalities on the Platform will depend on the user profile, as users must register first via a system of passwords assigned to them, which they may change at any time. Users are responsible for storing these passwords and are strictly prohibited from ceding them to unauthorised third parties.

Therefore, users are obligated to take any security measures needed to keep the confidentiality of the systems or access and verification codes established in relation to the Platform, so the FUNDACIÓN ONCE shall be released of any responsibility in this sense due to the negligence, carelessness or improper use by the user or any third party.

Likewise, users of the Platform pledge the following:

• To guarantee the authenticity, veracity, currency and accuracy of all data they share via the Platform; if not, the user is solely responsible.
• To use the Platform exclusively for the purposes and functionalities for which the FUNDACIÓN ONCE has set it up; it is prohibited for the user to use the Platform for any other purpose or means.
• To use the Platform legally and legitimately, avoiding any unauthorised, fraudulent, illegal or illegitimate use of it and/or of the contents and information made available on it, and to avoid violating this Legal Notice and the regulations in force or damaging the rights and legitimate interests of the FUNDACIÓN ONCE or any other third party which could be affected as a consequence of such action.
• To not cause damage to the physical or logical systems of the Platform, its suppliers or third parties, or ty try to breach its security or authentication measures, carry out any action that could lead to a disproportionate or unnecessary saturation of the infrastructure or the communications environment related to the Platform and the Service by in any way attacking it. The FUNDACIÓN ONCE may take any preventive or corrective measures needed to protect its interests to ensure the proper functioning of the Platform, the Service and their specific functionalities.
• Not to enter or spread online computer viruses or any other physical or logical system that could cause damage, like viruses, malware or other harmful programmes or files.
• Not to try to access, use and/or manipulate the data of the FUNDACIÓN ONCE, or data under its responsibility, or data of third-party providers or other users.
• In particular, for illustrative purposes but not exhaustively, the user pledges not to transmit, disseminate or make available to third parties any information, data, contents or messages which may constitute a violation of the rights of the FUNDACIÓN ONCE or third parties.
• To access without authorisation or interact with a false identity, supplanting or not the identity of third parties or using a profile or taking any other action that could prompt confusion or lead to error in the proper identification of the user.

5. INDUSTRIAL AND INTELLECTUAL PROPERTY.

The user acknowledges and accepts that all the industrial and intellectual property rights on the contents and/or any other element on the Platform (including but not limited to trademarks, logos, trade names, texts, images, graphics, designs, sounds, databases, software, presentation, audio and video, if added) are the exclusive property of the FUNDACIÓN ONCE or of third parties that have specifically authorised the FUNDACIÓN ONCE to use them.

Under no circumstances does access to or browsing of the Platform imply any type of waiver, transmission, license or total or partial cession of these rights unless explicitly stated in writing.

All the intellectual and industrial property rights to the contents and/or services of the Platform are reserved, and in particular it is prohibited to modify, copy, reproduce, publicly communicate, transform or distribute by any means and in any way all or part of the contents included in the Platform for public or commercial purposes without the prior explicit written authorization of the owners.

Any user who violates these limitations and prohibitions acknowledges that they alone bear any responsibility in this regard and hold the FUNDACIÓN ONCE harmless from any other third party that may be affected as a consequence of the user’s action.

6. EXCLUSION OF GUARANTEES AND RESPONSIBILITY.

FUNDACIÓN ONCE does not guarantee the availability and continuity of the operation of the Platform. Likewise, under no circumstances shall it be responsible for any damage that may arise from:

• Interruptions in the operation of the Platform or computer bugs, breakdowns, disconnections, delays or blocks caused by shortcomings or overloads in the systems of mechanisms that enable it to operate.
• The Platform’s unsuitability for users’ specific needs; and
• Any other damage that may be caused by third party via unauthorised interference beyond the control of the FUNDACIÓN ONCE.

We do not guarantee the absence of viruses or other elements in the Platform introduced by third parties from outside the FUNDACIÓN ONCE which may cause alterations in users’ physical or logical systems or in the documents, folders and files in their systems.

FUNDACIÓN ONCE shall take numerous measures to protect the Platform and its contents against computer attacks by third parties. However, it does not guarantee that unauthorised third parties may not gain access to the type of use of the Platform that the user makes or the conditions, characteristics and circumstances in which they use it. Consequently, under no circumstances shall it be responsible for any harm that may come from this unauthorised access.

FUNDACIÓN ONCE reserves the right to suspend access, without prior notice, of users who, in its judgement, fail to comply with the rules for using the Platform and to exercise any legal measures deemed appropriate, without this giving the user affected by this any right to indemnification. FUNDACIÓN ONCE accepts no responsibility under any circumstances for the way users and/or third parties use the Platform or for any damage that may stem therefrom.

FUNDACIÓN ONCE rejects any responsibility for any kind of damage that may be due to the use of the services and contents by the users, or that may be due to the lack of information, accuracy or lack of accuracy of the information that they provide on the Platform and in the Service, and in particular, though not exclusively, for any kind of damage that may be due to personality theft by a third party by a user in any kind of communication or action undertaken via the Platform.

7. APPLICABLE JURISDICTION.

Any dispute related to this Legal Notice shall be heard in the Spanish jurisdiction, and the parties explicitly agree to be subject to the jurisdiction of the Courts and Tribunals of the city of Madrid, unless the applicable regulation stipulate the competence of other Courts and Tribunals for this purpose.

9. CHANGES IN LEGAL NOTICE.

FUNDACIÓN ONCE reserves the right to change this Legal Notice in order to adapt it to future new laws, doctrines or jurisprudence which may be applicable, or for technical, operational, commercial, corporate or business reasons. It shall reasonably notify users of the changes in advance, whenever possible. In any case, we recommend that you read this Legal Notice in detail every time you access this Platform .
