Below is the Privacy Policy (henceforth, "WEB PRIVACY POLICY" or "policy") which governs the web Platform http://portalentochallege.es (henceforth, "the Platform"), owned by FUNDACIÓN ONCE, S.A. (henceforth, "FUNDACIÓN ONCE" or "us").

1. WHOM IS THIS POLICY TARGETED AT AND APPLIED TO?

This policy is applied to all the users of the Platform, regardless of whether or not they are clients of FUNDACIÓN ONCE (henceforth, indistinctly, "the user" or "the users"), who are considered natural persons. By personal data, we are ferring to all the information on an identified or identifiable natural person.

If you were already a client of FUNDACIÓN ONCE because you have signed a contract with us, you must also send us the information contained in it on the specific privacy terms.

This platform is targeted at users over the age of 18, and its use by minors is prohibited. Furthermore, the user acknowledges responsibly that they have sufficient legal capacity to contract the services offered by FUNDACIÓN ONCE, if applicable.

We try to request or apply the minimum data needed to process personal data in order to completely fulfil our purpose and mission, in line with the principles contained in the applicable regulations.

However, failure to provide your personal data could make it impossible for: 1) you to browse our website properly (failure to accept technical or session cookies); 2) us to process your specific request or application (such as due to failure to fill out or fill out properly the corresponding form or request).

In any case, the information and personal data you provide us, depending on each case, must be:

Generally speaking, we do not share your data with third parties, nor do we sell or offer them. However, third parties may access your personal information as they perform they services they provide to FUNDACIÓN ONCE, for example, in the case of the third-party cookies applied on the Platform (see cookies policy).

FUNDACIÓN ONCE has several data processors for the personal data under its control and allows them access to this data as trusted suppliers and only inasmuch as it strictly necessary to provide the contracted services. These data processors operate under a service contract under the terms, conditions and guarantees contained in article 28 of the GDPR, and the FUNDACIÓN ONCE checks, inspects and audits them as needed to check that these data processors strictly fulfil the contracts signed for that purpose and the applicable regulations.

9. ARE INTERNATIONAL TRANSFERS OF YOUR PERSONAL DATA MADE?

We hereby inform you that, generally speaking, no international transfers of your personal data are foreseen, and that FUNDACIÓN ONCE adopts the measures and guarantees needed in this sphere in accordance with the regulations in force on the protection of personal data.

Nonetheless, our Cookies Policy reports on the existence of possible international transfers of personal data related to the services that certain companies provide us (third-party cookies). All these international transfers are fully guaranteed according to the applicable regulations, and they are all entities included in the list of certified entities within the framework of Privacy Shield (see cookies policy).

Right to submit a complaint to the competent regulatory authority (AEPD) This entails the possibility of appealing to the regulatory authority if you believe that your personal data protection rights have been violated (articles 13 and 14 of the GDPR). 11. WHAT SECURITY MEASURES AND DATA PROTECTION DO WE APPLY TO YOUR PERSONAL DATA?

Bearing in mind the nature, scope, context and stated purposes of the processing, as well as risks with differing degrees of likelihood and severity for your rights and freedoms, FUNDACIÓN ONCE applies (and shall apply) suitable technical and organisational measures in order to guarantee the due security and protection of your personal data, bearing in mind privacy criteria in its design and by default, as well as by applying a concurrent risk-focused system which will be checked and updated by FUNDACIÓN ONCE when needed.

12. VALIDITY OF AND CHANGES TO THE PRIVACY POLICY

This Privacy Policy is valid starting on 1 January 2023.

FUNDACIÓN ONCE r the right to change this Privacy Policy in order to adapt it to future new laws, doctrines or jurisprudence which may be applicable, or for technical, operational, commercial, corporate or business reasons. It shall reasonably notify users of the changes in advance, whenever possible. In any case, we recommend that every you read this policy in detail every time you access this Platform because any change will be published on it.

Likewise, FUNDACIÓN ONCE may personally and previously inform you of any changes planned in this policy before it enters into force, as long as this is technically and reasonably possible, especially when you are a registered user or client of FUNDACIÓN ONCE.

14. COMPETENCE AND APPLICABLE JURISDICTION

Generally speaking, any controversy or conflict shall preferably be made known to the parties in order for them to find a mutual amicable solution using, for these purposes, the channel and email address provided for in section 13 of this policy.

If this is not possible, giving the criteria contained in the GDPR for determining the competence of the leading or main authority to hear any conflict, controversy, or claim around this Private Policy, at least, in the administrative route, users are hereby informed that that authority shall be the Spanish Data Protection Agency (AEPD), adhering to the provisions of article 56 of the GDPR. Regarding the right to effective legal protection against the FUNDACIÓN ONCE in these cases, the provisions of article 79.2 of the GDPR shall take effect, and the corresponding action may be filed with the Courts and Tribunals of the City of Madrid as the organisation responsible is a company located in Spain. The applicable Spanish and European regulations in this sphere shall prevail.
